Terms and Conditions

GENERAL TERMS AND CONDITIONS

1. I agree to abide by the rules of conduct, behaviour, equipment usage and use of services that are displayed within this studio and that have been provided to me
2. I agree that the membership fees are not refundable and I agree and understand that non usage of the studio does not allow early termination of this agreement nor does it warrant a refund of any type. I also agree and understand that non usage of the studio does not affect any payment terms and conditions of this agreement and that Virtual Studios Australia is in no way responsible for my level of usage of the studio.
3. I understand that my membership is for a term of 6 months and that my membership will roll over at the end of the 6 months term for an additional 6 months unless written notification to cancel is received 30 days prior to the end of the initial 6 months term.
4. I understand that a visit to the studio constitutes a period of one hour, and that each additional hour spent in the studio constitutes the beginning of a second visit.
5. If I choose, I may transfer my membership to another person who will fulfil the minimum membership term as set out in this agreement, this person must be approved by Virtual Studios Australia and this transaction is at Virtual Studios Australia's complete discretion.
6. Virtual Studios Australia may at their discretion terminate any membership agreement without notice for any non-compliance of this agreement or any behaviour or action that they deem inappropriate, this will require me to payout my membership for the remainder of the 6 month term. Virtual studios Australia will deduct these fees via direct debit or bill if funds are unavailable.
7. Facilities and services may change without prior notice. Any such changes will not affect the terms of my membership agreement.
8. I understand that under no circumstances are members permitted to bring children into the Studio, nor are they permitted to leave children unattended in any area of the Studio at any time, and that Virtual Studios Australia accepts no responsibility for children either brought into the studio or left in the studio by a parent or guardian.
9. As a member of Virtual Studios Australia you are entitled to a specific number of visits as set out in your requested membership, I understand this is limited to a number of visits per month. I fully understand that Virtual Studios Australia monitor my visits and any visits which exceed the agreed membership amount will be charged a $19.95 (subject to change) which will be automatically debited from my bank account or credit card each debit.

DIRECT DEBIT MEMBERS SPECIAL CONDITIONS

10. I am aware Direct Debit payments are managed and debited on behalf of Virtual Studios Australia by a third party billing company and that I have read the third party billing companies Service Agreement and fully understood all points contained within it
11. I understand that membership rates are reviewed periodically and may increase by an amount not exceeding 10%. This is regardless of the contract amount or contract term. I understand that members will be notified a minimum of 30 days prior to any such membership rate increase by way of email or writing delivered by post.

VIRTUAL STUDIOS AUSTRALIA MEMBERS ADDITIONAL CONDITIONS

12. I understand and accept that if I provide access to the studio for a non-member or a member who has lost or damaged their Personal Access Card (PAC) that I will have my membership immediately cancelled and I will be charged a $500 penalty which will be automatically debited from my bank account or credit card. I understand that this policy is applicable regardless of whether the person I provide access to is an existing member of the Virtual studios Australia membership system or not.
13. I understand and accept that if I intentionally activate a Duress Button or a Personal Duress Lanyard with no reason or for a reason that is deemed not appropriate by Virtual Studios Australia that I will be charged a $500 penalty which will be automatically debited from my bank account or credit card. Virtual Studios Australia will only use this money to recover the costs associated with false activation of a Duress Button.
14. I am aware that all Virtual Studios (Australia) are equipped with Video Surveillance technology which is constantly recording for the security of the studio and that the Video Surveillance can be remotely viewed at any time by the studio operator and/or security provider.
15. I agree and recognise that I have been provided with a New Member Information document. I fully understand and agree to abide by all of the terms, conditions, policies and instructions contained within this document
16. I acknowledge that I am aware of all surroundings, equipment and facilities of the studio and I agree to release and indemnify Virtual Studios Australia entirely, and any company associated with Virtual Studios Australia. I agree to participate in all activities at my own risk and responsibility whether supervised or not by staff. I agree to release and hold harmless Virtual Studios Australia and any associated parties from and against all actions, which may be brought about by me or on behalf of me in respect of any incident arising out of injury, loss, damage or death caused to me or my property in any way what so ever.
17. At Virtual Studios Australia we take your privacy seriously. We do not pass your information onto any other business. If you do not wish to receive email, sms or mail correspondence from us regarding your membership, special offer, promotions or your value adds then please send us an email or letter confirming that you wish to unsubscribe for such methods of communication.
18. I understand that the Virtual Studios Australia system is a membership program with a membership base decided at the complete discretion of Virtual Studios Australia and companies associated with, I do not hold any right in advising my membership to be unjustified due to the membership numbers held by Virtual Studios Australia.
19. I understand that I must pre book all visits to Virtual Studios Australia (Studio of my choice), failure to do so where I enter for use will be deemed a breach of membership terms. I will be charged a $500 penalty which will be automatically debited from my bank account or credit card. In addition my membership may be terminated, at the discretion of Virtual studios Australia.
20. I understand that the Virtual Studios Australia works by a booking system, and at times bookings may be back to back, I hold myself and my clients completely responsible for their own time and understand that I will need to vacate the studio completely leaving in a clean and tidy condition for the next studio member to enter as per their booking time. I will use my exit form to ensure my exit requirements are met.
21. I understand that all equipment used within the studio by me as a member is to be handled with care, any damage caused to any aspect of the studio during my use will be considered an interruption to business by Virtual studios Australia, this will be fixed at the discretion of Virtual Studios Australia and billed as appropriate to me as a member.
22. I understand that Virtual Studios Australia provides a facility to a membership base, I understand that I must use the wipes provided to wipe down all used aspects of the studio and leave clean and tidy, prior to my departure, failure to do so will result in a warning issued, Virtual Studios Australia hold complete discretion as to and if my membership can be cancelled.
23. I understand that downgrade of my membership during my membership term is not permitted, I may request amendments for an upgrade, however it will be at the complete discretion of Virtual Studios Australia if deemed applicable and granted.
24. I understand that Virtual Studios Australia Membership fees include an administration charge and or direct debit fees as outlined in my direct debit agreement.
25. I understand that Virtual Studios Australia charges a $49 access card fee which is non-refundable. Lost access cards will be charged at an additional non-refundable fee of $49.

CANCELLATION SPECIFIC TERMS.

26. I understand that Virtual Studios Australia has a strict cancellation policy, I must provide 30 days' notice PRIOR to the end of the 6 month membership term, failure to do so I understand that my membership will roll over to the next 6 month term and I will be unable to cancel my membership until the next term has been completed at this stage standard cancelation conditions apply.
27. I understand that Virtual Studios Australia provides exclusive member benefits such as the addition of studio address and reference to Virtual Studios Australia as a whole on print & digital collateral, I understand it is my responsibility to remove prior to requesting my cancelation of membership.
28. I understand that Virtual Studios Australia has a cancellation audit policy, as part of this policy I must provide evidence via a screen shot of website, digital material, print and or any other reference material proving that all reference to Virtual Studios Australia has been removed.
29. I understand that failure to submit this evidence mentioned in clause (26) will deem my membership still active, therefore debits will continue. Virtual Studios Australia may at their discretion provide a further grace period of 4 weeks maximum to submit this evidence allowing cancelation to still commence, during this 4 weeks my regular debits will continue however Virtual studios Australia will allow my cancelation to proceed without rolling over to the next 6 month term.
30. I understand that if after the membership cancelation is requested and the 4 weeks grace period is provided (at the discretion of Virtual Studios Australia) and there is still reference to Virtual Studios Australia on any member collateral, my membership will roll over for another 6 months.
31. STATEMENT: (Thieffects your legal rights): s I understand that this Studio is not able to provide me with business advice with regards to my business dealings and that this information is used as a guideline to the limitations of my ability to conduct business. I will not hold this studio liable in any way for any injuries or business interruption that may occur while I am on these premises, or result thereafter apart from any normal public liability applicable as per normal daily operation of this studio.
32. REQUIREMENT: I understand that as a member of Virtual Studios Australia, I must hold my own public liability insurance and provide to Virtual Studios Australia upon sign up as requested in order for my membership to commence.
